Brazilian may return to Portugal after court recognizes administrative obstacle from AIMA
A Brazilian woman who complied with a voluntary abandonment notification can return to Portugal, marking an unprecedented legal case. Lawyer Priscila Nazareth Ferreira highlighted that the administrative obstacles faced by the immigrant were not her fault. The young woman, who turned 20, struggled with family reunification after reaching adulthood, as her residence permit request was denied due to insufficient contribution history. The case was filed after she had left Portugal but within the legal timeframe for appeal. The court reversed the decision, emphasizing that complying with an exit order does not forfeit the right to contest it. This ruling may set a precedent for other immigrants in similar situations, allowing them to return despite previous notifications of voluntary abandonment. The woman's name has been removed from the Schengen restrictions, enabling her return to Portugal where her family resides.
