Jerzy Lachowski: Higher fines will make penalties more adequate

The Criminal Law Codification Commission has proposed amendments to the Misdemeanor Code, primarily increasing fines from 5,000 to 30,000 PLN. This change aims to address outdated penalties and align them with current economic standards. The proposal also seeks to redefine the application of arrest, limiting it to intentional misdemeanors and ensuring proportionality in sentencing. Critics argue that the project does not adequately address urgent needs and that some provisions merely replicate existing criminal law solutions. The commission emphasizes the importance of feedback from practitioners and aims to create a more coherent legal framework between misdemeanors and criminal law.
