Children born from incest are now entitled to compensation

The Council of State ruled that a man born from incest is entitled to compensation, reversing a previous decision by the Compensation Fund. The man, whose mother was a victim of abuse by her father, was initially denied compensation as the abuse was not considered a crime against him. However, the Council found that both the mother and son suffered psychological issues due to the incest, impacting the son's right to psychological integrity and identity development. The Compensation Fund must make a new decision within seven weeks. The man had appealed after being denied compensation in 2023, and a lower court had previously ruled in his favor, linking his injuries directly to his mother's abuse.
