Kozsó's dolphins and AI: the European Court may side with publishers
The European Court of Justice is examining the relationship between generative AI and press publishers' rights in a Hungarian case. Advocate General Maciej Szpunar suggests that AI chatbots may infringe on publishers' rights by reusing content from online articles. The case stems from a dispute between Like Company and Google Ireland regarding the use of a specific article about dolphin relocation. Szpunar emphasizes the distinction between facts in articles and their specific expressions, stating that while facts can be freely reported, the unique wording cannot be used without restrictions. The court must clarify the conditions under which generative AI can utilize online press products and the rights of content creators. This case could set a precedent for how digital content creators are protected in an increasingly AI-driven information market.
