When the coffin meant to be buried remains exposed to the open air
During the All Saints' Day, families visit cemeteries to honor deceased relatives. In France, burial options are limited to in-ground or vault interments, with above-ground "enfeu" burials allowed under certain conditions. A case arose when three siblings hired Roc Eclerc for their mother's funeral, paying €6,750 for a compliant coffin. However, they later discovered the coffin was not suitable for above-ground placement in Portugal, leading to leakage issues. After replacing the coffin at a cost of €4,445, they sought a contract resolution and refund from Roc Eclerc. The Paris court initially dismissed their claim, but the appellate court found Roc Eclerc liable for selling a non-compliant product and ordered compensation for the siblings' moral damages.
