Councillors cannot introduce their own definition of a large family. NSA ruling on exemption from waste fees

The Supreme Administrative Court reminded local authorities about regulations regarding waste management fees. A dispute arose over a resolution aimed at partially exempting large families from waste fees. In 2020, councilors from a suburban area proposed a 15 PLN reduction for property owners with large families as defined by the Large Family Card law. They also included their own definition of a large family, requiring at least three children living at the same address. Additionally, to qualify for the discount, applicants had to submit a copy of the valid Large Family Card and provide the addresses of eligible family members.
